1. About OpsGenty

OpsGenty (trading as Operations Agency) is an AI automation and business development company registered in South Africa. We provide AI-powered operational systems, automation infrastructure, and digital business solutions to individuals and businesses.

2. Acceptance of Terms

By accessing our website at opsgenty.com or purchasing our services, you confirm that you:

• Are at least 18 years of age
• Have the legal authority to enter into a binding contract
• Have read and agree to these Terms of Service and our Privacy Policy

3. Services Offered

OpsGenty provides the following subscription-based AI automation tiers:

• CORE (R3,650/mo): AI missed-call text-back, reputation engine, unified inbox, digital lobby
• FOUNDRY (R7,350/mo): All CORE features + AI booking bot, sovereign billing, automation workflows
• CATALYST (R9,200/mo): All FOUNDRY features + social scheduling, AI content suite, ads dashboard
• FORTRESS (R12,900/mo): All CATALYST features + custom AI staff, GSO, white-glove support, data vault

4. Payment Terms

• All prices are quoted in South African Rand (ZAR) and are inclusive of applicable taxes
• Subscriptions are billed on a monthly recurring basis via Paystack
• Payment is due in advance at the start of each billing cycle
• By subscribing, you authorise OpsGenty to charge your chosen payment method monthly
• Failed payments may result in suspension of services
• All transactions are processed securely via Paystack (PCI-DSS compliant)

5. Cancellation Policy

• You may cancel your subscription at any time with no cancellation fees
• Cancellations take effect at the end of the current billing period
• You will retain access to services until the end of the paid period

6. Refund Policy

We offer a 30-day money-back guarantee on all subscription plans. Please refer to our full Refund Policy for complete details.

7. Onboarding and Delivery

• After successful payment, you will receive an onboarding email within 24 business hours
• Full system deployment typically takes 3–7 business days depending on your tier
• You agree to provide accurate business information required for setup

8. Intellectual Property

• OpsGenty retains ownership of all proprietary systems, templates, and methodologies
• You retain full ownership of your business data, customer data, and content
• You are granted a non-exclusive, non-transferable licence to use OpsGenty's systems during your subscription

9. Acceptable Use

You agree NOT to use OpsGenty services for:

• Any illegal, fraudulent, or deceptive activities
• Sending spam or unsolicited bulk communications
• Violating the rights of third parties
• Any activity that violates South African law or applicable international regulations

10. Limitation of Liability

To the maximum extent permitted by South African law, OpsGenty shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions caused by third-party providers or force majeure events

Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

11. Service Availability

We strive for 99% uptime. Scheduled maintenance will be communicated in advance. We are not responsible for downtime caused by third-party integrations, internet outages, or force majeure events.

12. Data Protection

We process your personal information in accordance with POPIA (Act 4 of 2013). Please refer to our Privacy Policy for full details.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Gauteng, South Africa. We will first attempt to resolve disputes amicably within 30 days of written notice.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you via email at least 14 days before material changes take effect. Continued use of our services after the effective date constitutes acceptance of the new terms.
